On the morning of March 23, Lawyer Nguyen Trung Nam, Director of VIArb; Arbitrator, VIAC; Member lawyer, EPLegal participated in the Scientific Conference with the theme: “Contemporary issues in international arbitration” organized by Ho Chi Minh City University of Law with two forms: online via Zoom and in person.
The seminar was chaired by Assoc.Prof.Dr. Tran Viet Dung – Dean of the Faculty of International Law, University of Law, Ho Chi Minh City; Prof. Dr. Do Van Dai – Dean of the Faculty of Civil Law with the participation of a large number of speakers, researchers, and experts in practice.
The workshop consisted of 10 papers selected to be presented in 02 main sessions, with the topics of each session respectively: “Some legal and practical issues on Arbitration’s Jurisdiction” and “Some legal and practical issues on Arbitration proceedings.”
Together with scholars, lawyer Nguyen Trung Nam brought to the first session realistic topics of high times “Arbitration Agreement – A perspective comparing Vietnamese and Korean laws for the relationship with the Model Law 2006”, focusing on three main issues: Forming an arbitration agreement; The validity of the arbitration agreement; Changing and supplementing the parties and other contents in the arbitration agreement, on the basis of comparing the Vietnamese law with the Korean law in relation to the Model Law on International Arbitration.
Below is the full paper of lawyer Nguyen Trung Nam. The paper uses a comparative approach to review and evaluate the legal systems of Vietnam and Korea on arbitration agreements to see how the laws of these two countries address the issues raised by the author. The paper also compares these provisions with the Model Law 2006 version to determine the differences and shortcomings in the Vietnamese legal system compared with international arbitration practice.
